Noise

The City’s Environmental Health Services section aims to ensure noise levels in the community do not negatively impact on people’s health and wellbeing. We do this by checking that new developments are designed to minimise noise impact and responding to complaints from residents.

Particular focus is placed on resolving noise problems that interrupt sleep and/or are of an ongoing nature as these situations have been demonstrated to have serious health impacts.

If you have a problem with the types of noise listed below, our Environmental Health Officers may be able to help you. However we always recommend trying to resolve the matter directly with the person causing the noise as it often leads to better outcomes for all concerned. A number of common sources of noise are listed below.

 

Air Conditioning

In Western Australia, the noise from an air conditioner installed on a property must comply with the Environmental Protection (Noise) Regulations 1997. If you are having a problem with an air conditioning unit which you believe is making excessive noise the City of Mandurah can investigate the matter. If you wish to lodge a complaint you will be required to submit a Noise Service Request in writing to the City.

 

Alarms

The Mandurah Police have the power to inactivate house or car alarms if the alarm is emitting unreasonable noise. Environmental Health Officers do not have powers to switch off alarms and all requests of this type must be directed to the police. They can be contacted on 9581 0222.

 

Construction Noise

Noise above levels set in the Environmental Protection (Noise) Regulations 1997 can be emitted from construction sites (such as building developments) between 7:00am and 7:00pm Monday to Saturday only. Work outside these hours is permitted but Council must grant prior written approval.

To resolve construction noise issues it is recommended that residents contact the building or construction supervisor (details on the sign at the site) initially as this usually resolves problems in most cases. If this does not resolve the matter, and you want an Environmental Health Officer to investigate the matter you will be required to submit a Noise Service Request in writing to the City.


Domestic Equipment

Lawnmowers, chainsaws and musical instruments can only be used between 7:00am and 7:00pm Monday to Saturday and between 9:00am and 7:00pm on Sundays or Public Holidays.

Lawnmowers, chainsaws, power tools etc can be used for a maximum of two hours in any day. Musical instruments can be used for a maximum of one hour in any day.

If you are being affected by noise outside of these times and you wish to lodge a complaint you will be required to submit a Noise Service Request in writing to the City.
 

Licensed Venues

The City’s Environmental Health Services section monitors noise from licensed premises and if necessary action can be taken under the Environmental Protection (Noise) Regulations 1997. The Liquor Control Act 1988 also contains provisions that allow action to be taken for unreasonable noise. Please complete a Noise Service rRequest and return to the City of Manduarh. Residents can also take action independently of the City under section 117 of the Liquor Control Act 1998.

 

Noisy Parties

The Mandurah Police can deal with noise from 'one-off parties' and have similar powers to Environmental Health Officers. They can be contacted on 9581 0222.

Where there is an ongoing issue where parties are being held regularly and they are interfering with the wellbeing of neighbours, the Police and the City's Environmental Health Officers can work together to resolve the situation. If noisy parties are an ongoing problem for you and you wish to lodge a complaint you will be required to submit a Noise Service Request in writing to the City.

 

Other Noises

The City’s Noise Information Sheet provides further details of permitted noise levels and actions that may be taken for continued excessive noise. If you believe that noise is unreasonably interfering with your health, welfare and amenity a Noise Service Request can be completed and submitted to the City's Environmental Health Services section. An Environmental Health Officer will investigate your request and if appropriate, take action to ensure noise levels are in accordance with the legislation.

Please note that there are some types of noise that cannot be investigated by the City such as vehicles on roads and wild animals.
